Welcome to TheDecantPlace.com. By placing an order on our website, you enter into a legally binding contract. Please read these terms carefully.
1. General & Updates
1.1 TheDecantPlace.com provides a platform for fragrance enthusiasts to purchase hand-decanted scent samples for olfactory evaluation only. We do not sell full-size original bottles.
1.2 We reserve the right to update these terms. Changes take effect upon posting. Continued use of the site indicates acceptance of the updated terms.
2. Affiliation, Authenticity & Nature of Goods
2.1 We are not affiliated, associated, or sponsored by any fragrance brands, designers, or trademark owners. All brand names and logos remain the property of their respective owners and are used for identification purposes only.
2.2 All samples are decanted from genuine fragrance bottles purchased from authorized retailers. Authenticity is guaranteed.
2.3 Samples are hand-filled into neutral, sterile sprayers. Original bottles or designer packaging are not included.
3. Product Use & Legal Disclaimer
3.1 Olfactory Use Only: In accordance with EU regulations regarding decanted products, our samples are sold exclusively for olfactory exploration (scent evaluation).
3.2 We do not recommend applying these samples to the skin or clothing, as they are not original factory-sealed cosmetic products. Use beyond olfactory evaluation is at the sole risk and responsibility of the user.
4. Prices & Payment
4.1 All prices are listed in Euro (EUR).
4.2 We accept payments via cards and bank transfer.
4.3 Prices are locked at the time of checkout. We reserve the right to change prices for future orders without notice.
5. Shipping & Delivery
5.1 We ship worldwide. Delivery times are indicative and vary by destination.
5.2 International Orders: Customers outside the EU are responsible for all customs duties, import taxes, or local fees.
5.3 Delivery Risk: In compliance with EU law, the risk of loss or damage remains with us until you (or a third party designated by you) take physical possession of the goods.
5.4 Failed Delivery (Customer Error): If a package is returned to us (Return to Sender) due to an incorrect/incomplete address, or failure to collect the package from a pickup point:
Original shipping fees are non-refundable.
The actual cost of return shipping charged by the carrier will be deducted from your refund.
If you request a reshipment, new shipping charges will apply.
5.5 Visibility: It is the customer's responsibility to ensure their name is clearly visible on the mailbox or doorbell.
6. Important Note for Customers in Italy
Due to the specific delivery procedures of Poste Italiane, we strongly recommend utilizing the PostePlus service. This free service allows you to manage delivery windows. Please note that if a package is returned to us after a failed delivery attempt where the customer was unreachable or the address was inaccessible, the provisions in Clause 5.4 (non-refundable shipping and charged return costs) will apply.
7. Right of Withdrawal & Returns
7.1 14-Day Right of Withdrawal: Under EU law, you have the right to cancel your purchase within 14 days of receiving the goods without giving a reason.
7.2 Hygiene Exception: Pursuant to Article 16(e) of Directive 2011/83/EU, the right of withdrawal does not apply to sealed goods which were unsealed after delivery and are not suitable for return due to health protection or hygiene reasons. Therefore:
We only accept returns for samples that are completely sealed and unused.
If the seal is broken or the sample has been sprayed, a refund will not be issued.
7.3 Return Process: To initiate a return, contact us within 14 days. You must return the goods within 14 days of your notification. The direct cost of return shipping is the responsibility of the customer.
7.4 Refunds: We will process your refund (minus shipping/return costs if applicable) within 14 days of receiving the returned goods.
8. Damaged or Incorrect Items
8.1 Please inspect your order upon receipt. If an item is damaged or incorrect, please notify us with photographic evidence.
8.2 While we appreciate reports within 48 hours for insurance purposes, your statutory legal rights regarding defective goods remain valid under EU warranty laws.
9. Liability Limitation
9.1 Our liability is limited to the purchase price of the products.
9.2 We are not liable for incidental or consequential damages, including but not limited to allergic reactions resulting from use of the product contrary to the "olfactory use" instruction in Clause 3.1.
10. Intellectual Property
10.1 All content on TheDecantPlace.com is our property. Unauthorized reproduction is prohibited.
11. Governing Law
11.1 These terms are governed by the laws of the country where TheDecantPlace.com is registered, without prejudice to mandatory consumer protection laws in your country of residence.
